Cold calling becomes substantially more effective as part of a coordinated marketing campaign. Rather than receiving an unexpected call, the target database can first be exposed to the proposition through introductory email, direct mail, benefit communications, case studies, testimonials, sector content, digital advertising or LinkedIn activity, continuing up to and around the point of the call.

Every stage added after the customer has decided creates a chance to lose the sale. Asking an enthusiastic prospect to visit a website, complete a form or pay later introduces unnecessary friction. The objective is to make joining as simple as possible while ensuring the customer clearly understands the proposition, price and contractual terms.

B2B Direct Sales and Cooling-Off Periods

Where membership is sold to independent retailers for their business, the transaction is normally business-to-business rather than a consumer contract. The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 define a consumer as an individual acting wholly or mainly outside their trade or business, so a retailer buying membership mainly for business benefit would not ordinarily qualify.

As a result, there is no general statutory 14-day cooling-off period for ordinary B2B contracts of this kind. Subject to the client’s terms, a qualifying business member can normally agree and pay during the call. However, if an individual is buying principally for personal purposes, consumer cancellation rights may apply, so particular care is needed with sole traders and very small businesses to confirm the purchase is genuinely for business.

BDM CX recommends the sales process clearly explains the membership price, billing frequency, minimum period (if any), renewal arrangements, cancellation provisions, principal benefits, and confirmation that the person agreeing has authority to do so. Exact terms and payment processes should be reviewed and approved by the client’s legal/compliance team before launch.

Compliance with Outbound B2B Calling

Although a B2B sale won’t generally attract a consumer cooling-off period, outbound marketing remains regulated. The Privacy and Electronic Communications Regulations apply to B2B telephone marketing. Before making live calls, businesses should screen numbers against the Telephone Preference Service (TPS) and Corporate Telephone Preference Service (CTPS) and maintain their own suppression records; a business that has objected should not be called again.

Callers should identify their organisation, display an appropriate number and provide contact details on request. Where personal data on an identifiable business contact is processed, UK GDPR also applies. This reinforces the value of high-quality, properly sourced and screened data, which affects both conversion rates commercially and, from a compliance view, whether prospects can appropriately be contacted.

Selling Value Rather Than Price

Subscription selling is fundamentally different from a one-off sale: the prospect is entering an ongoing relationship, so the conversation must establish continuing value. Our approach focuses on understanding what problem the prospect has, what commercial or operational value the service provides, why they should act now, and what would prevent them from subscribing.
